Prohibited Use Policy

This Prohibited Use Policy applies to your use of the Platform, our mobile application, or any other website we operate (collectively, the “Tria Site”) or the Card Program Interface. Capitalized terms not defined herein shall have the meanings ascribed to them in our Terms of Service (our “Terms’). The policies outlined herein play an important role in keeping our ecosystem safe.

1. GENERAL PROHIBITIONS

You may not use the Tria Site or Card Program Interface in any manner that: (a) would violate, or assist in violation of any Applicable Law or Sanctions program; (b) contravenes Card Network rules, Card Program Provider requirements, the Terms, or the requirements outlined herein; or (c) circumvents or limits authentication or risk control measures imposed by Tria, its services providers, or other third parties.

You are strictly prohibited from using the Tria Site, Card Program Interface, or the Services to engage in mixers, tumblers, privacy-enhancing coins where prohibited, or any similar service designed to obscure the origin of funds. Market manipulation, insider trading, fraudulent investment schemes, structuring transactions, layering transactions, smurfing or other suspicious or illegal activity with the intent to evade reporting or statutory reporting requirements is strictly prohibited.

2. PROHIBITED USE

You may not use your Tria Account to engage in the following categories of activity (each a “Prohibited Use”). The specific types of activities listed below are representative, and are not exhaustive.

A. Unlawful Activity. Activity which, in any way, would violate, or assist in violation of, any Applicable Law or Sanctions programs administered in the countries where Tria conducts business including but not limited to the U.S. Department of Treasury’s Office of Foreign Asset Control (“OFAC”), or which would involve proceeds of any unlawful activity; publish, distribute, or disseminate any unlawful material or information.

B. Abusive Activity. Actions that (i) impose un unreasonable or disproportionately large load on our infrastructure or detrimentally interfere with, intercept, or expropriate any system, data, information, underlying blockchain network or technologies, or any other functionality with which is related to our infrastructure causing such technologies to work other than as intended; (ii) damage our reputation, or impair any of our legal rights or interests; (iii) engage in any activity or behavior that violates any Applicable Law concerning or damages the integrity of our infrastructure or any other service or software which relies on such technologies; (iv) disable, overburden, damage, impair, or interfere with our infrastructure, including the ability to engage in real time activities; (v) transmit or upload any material to the Tria Site that contains viruses, robot, spider, Trojan horses, worms, or any other harmful or deleterious programs; (vi) attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Tria Site, the server on which the Tria Site, Card Program Interface, or information in connection with such software and related information is stored, whether through password mining or any other means; (vii) use a VPN software or any other privacy or anonymization tools or techniques intended to circumvent, or attempt to circumvent, any restrictions that apply to accessing the Tria Platform or Tria Site; or (viii) transfer your Tria Account access or rights to a third party, unless by operation of law or with the express permission of Tria.

C. Abusive of Others. (i) Interfere with another individual’s access to or use of the Services; (ii) defame, abuse, extort, harass, stalk, threaten or otherwise violate or infringe the legal rights of other including but not limited to rights of privacy, publicity and intellectual property; (iii) impersonate or attempt to impersonate Tria, an employee, another user, or any other person or entity (including, without limitation, by using email addresses, screen names, similarly named or commonly misspelled URLs, or associated blockchain identities); (iv) harvest or otherwise collect information from the Tria Site about others including without limitation email addresses, without proper consent; or (v) incite, threaten, encourage, or promote hate, racial intolerance, or violent acts against others.

D. Fraud. Activity which operates to deceive or defraud, or attempt to deceive or defraud, Tria, Tria’s users, or any other person, or providing any false, inaccurate, or misleading information to Tria.

E. Unlawful Gambling. Engaging in: lotteries; bidding fee auctions; sports forecasting or odds making; fantasy sports leagues with cash prizes; Internet gaming; contests; sweepstakes; or games of chance.

F. Intellectual Property Infringement. (i) Engage in transactions involving items that infringe or violate any copyright, trademark, right of publicity or any other proprietary right under the law including but not limited to sales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder; (ii) use of Tria intellectual property, name, or logo, including use of any Tria trade or service mark, without Tria’s express consent or in a manner that otherwise harms Tria or its brand; or (iii) any action that implies an untrue endorsement by or affiliation with Tria.

3. PROHIBITED BUSINESSES

In addition to the Prohibited Uses described above, the following categories of businesses, business practices, and sale items are strictly prohibited from the Services (collectively, “Prohibited Businesses”). Most Prohibited Business categories are imposed by Card Network rules or the requirements of a Card Program Provider. The specific types of use listed below are representative, and not exhaustive. You confirm that you will not use the Services or the Tria Card (if businesses are provided such access or use) in connection with any of the following businesses, activities, practices, or items.

A. Investment and Credit Services. Securities brokers; mortgage consulting or debt reduction services; credit counseling or repair; real estate opportunities; investment schemes.

B. Restricted Financial Services. Check cashing, bail bonds; collections agencies.

C. Intellectual Property or Proprietary Rights Infringement. Sales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder.

D. Counterfeit or Unauthorized Goods. Unauthorized sale or resale of brand name or designer products or services; sale of goods or services that are illegally imported or exported or which are stolen.

E. Regulated Products and Services. Marijuana dispensaries and related businesses; sale of tobacco, e-cigarettes, and e-liquid; online prescription or pharmaceutical services; age restricted goods or services; weapons and munitions; gunpowder and other explosives; fireworks and related goods; toxic, flammable, and radioactive materials; products and services with varying legal status on a state-by-state basis.

F. Drugs and Drug Paraphernalia. Sale of narcotics, controlled substances, and any equipment designed for making or using drugs, such as bongs, vaporizers, and hookahs.

G. Pseudo-Pharmaceuticals. Pharmaceuticals and other products that make health claims that have not been approved or verified by the applicable local and/or national regulatory body.

H. Substances designed to mimic illegal drugs. Sale of a legal substance that provides the same effect as an illegal drug (e.g., salvia, kratom).

I. Adult Content and Services. Pornography and other obscene materials (including literature, imagery, and other media); sites offering any sexually related services such as prostitution, escorts, pay-per view, adult live chat features.

J. Multi-level Marketing. Pyramid schemes, network marketing, and referral marketing programs.

K. Unfair, predatory, or deceptive practices. Investment opportunities or other services that promise high rewards; Sale or resale of a service without added benefit to the buyer; resale of government offerings without authorization or added value; sites that we determine in our sole discretion to be unfair, deceptive, or predatory towards consumers.

L. High risk businesses. Any businesses that we believe poses elevated financial risk, legal liability, or violates card network or bank policies.

4. SANCTIONS & RESTRICTED JURISDICTIONS

You should not access the Tria Site or Card Program Interface, apply for a Tria Card, or otherwise use the Services or Tria Card if you are:

A. Located, organized, or a resident in any country or territory subject to law, regulations, and treaties including, without limitation, export restrictions, end-user restrictions, anti-terrorism law, anti-money laundering law, trade sanctions, and economic sanctions imposed administered or enforced by the European Union, the United Kingdom, the United Nations Security Council, the United States Department of Treasury’s Office of Foreign Asset Control, the United States Department of State, the United States Department of Commerce, and any other applicable national, regional, provincial, state, municipal, or local law or regulation (collectively, “Sanctions”).

B. Under the control of any person or entity located, organized, or a resident in any country or territory subject to Sanctions.

C. Located in, a resident of or otherwise transacting with a country, territory, or entity subject to Sanctions including, without limitation, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, or Luhansk regions of Ukraine.

D. Located in, or transacting with, jurisdictions that Tria prohibits due to high money-laundering, fraud, or compliance risk, including but not limited to: Afghanistan, Belarus, Central African Republic, Democratic Republic of the Congo, Eritrea, Ethiopia, Guinea, Guinea-Bissau, Iraq, Lebanon, Libya, Mali, Myanmar, Nicaragua, Russia, Somalia, South Sudan, Sudan, Venezuela, Yemen, Myanmar, and Zimbabwe.

E. A citizen, resident, located, or organized in a jurisdiction where your access or use would otherwise be illegal.

5. RELATIONSHIP TO THE CARDHOLDER AGREEMENT

Tria’s Prohibited Use Policy supplements and should be read together with the Terms and the applicable Cardholder Agreement. In addition to the prohibitions set out in this Prohibited Use Policy, you must comply with all restrictions, limitations, and requirements described in your Cardholder Agreement, including any restrictions on types of transactions, geographic use, security obligations, and requirements to comply with all Applicable Laws and network rules. Where there is a conflict between this Prohibited Use Policy, the Terms, or the Cardholder Agreement, the stricter requirement will apply.

6. COMPLIANCE WITH CARD PROGRAM PROVIDERS AND NETWORK RULES

You must comply with the Cardholder Agreement applicable to you, the rules of the payment network associated with your Tria Card, and any additional restrictions imposed by one or more Card Program Providers. If there is a conflict between those rules and this Prohibited Use Policy, the stricter requirement applies.
