Electronic Communications Policy

This Electronic Communications Policy describes how Threely Dimensions, Inc. ("Tria," "we," "our," or "us") delivers communications to you electronically. This Electronic Communications Policy applies when you interact with the products, services, technology, features, and software (collectively, the "Services") we make available to you via our electronic platforms and applications (the "Platform"). Capitalized terms not defined herein shall have the meanings ascribed to them in our Terms of Service (our "Terms'). We may amend this policy at any time by providing the revised notice on our website. The revised version will be effective at the time we post it.
Electronic Delivery of Communications
You agree and consent to receive electronically all communications, agreements, documents, notices, and disclosures (collectively, "Communications") that we provide in connection with your use of the Platform, Services, and Tria Account. Communications include:
- Agreements and policies you agree like, for example, the Terms of Service and Privacy Policy, including updates to such agreements or policies;
- Account details, history, transaction receipts, confirmations, and any other account or transaction information;
- Legal, regulatory, and tax disclosures or statements we may be required to make available to you; and
- Responses to claims or customer support inquiries filed in connection with your account.
We will provide these Communications to you by posting them on the Platform, emailing them to you at the primary email address listed in your profile, communicating with you via instant chat, and/or through other electronic communication such as text message or mobile push notification, subject to Applicable Law.
You agree that electronic records and electronic signatures satisfy any "in-writing" and/or signature requirements and have the same legal effect as paper records and handwritten signatures, to the maximum extent permitted by Applicable Law. You may be asked to indicate your acceptance to a contract or policy by clicking on an "I Agree" or "I Accept" button or check box, typing your name, using a designated acceptance mechanism in the Platform or by continuing to use the Platform after posting revised Terms.
Hardware and Software Requirements
In order to access and retain electronic Communications, you will need the following computer hardware and software:
- A device with an Internet connection;
- A current web browser that includes 128-bit encryption (e.g., Internet Explorer Version 9.0 and above, Firefox version 3.6 and above, Chrome Version 31.0 and above, or Safari 7.9 and above) with cookies enabled;
- A valid email address (your primary email address on file with Tria); and
- Sufficient storage space to save past Communications or an installed printer to print them.
Third Party Communications
Third parties may send their own legally required notices, disclosures, or statements directly to you, and such communications will be governed by their respective electronic communications policies and procedures. Tria may, as a convenience, display or relay those communications through the Platform, but Tria is not and will not be, at any time, liable or responsible for the form, content, timing, or sufficiency of such third-party communications. Tria's role is limited to providing Platform-level notices relating to your account and use of the services.
Joint Communications
Certain services accessible via the Platform are made available by third parties and services providers. Such third parties may be legally or contractually required to send notices, disclosures, statements, or other communications directly to you like, for instance transaction receipts, billing statements, collateral or repayment notices, adverse action letters, or regulatory disclosures. Tria may, as a convenience, display or relay some of these communications on the Platform but does so only as an outlet for such communications and does not control the content, form, timing, or legal sufficiency of any communications originating from these third parties.
In the event of any inconsistency between a Communication from Tria and a communication provided by a third party regarding the same matter included in the communication, such third party's terms and policies govern the matters that are the third party's responsibilities.
How to Withdraw Your Consent
You may withdraw your consent to receive Communications electronically by contacting us at [email protected]. If you fail to provide or if you withdraw your consent to receive Communications electronically, Tria reserves the right to immediately close your Tria Account or charge you additional fees for paper copies. Withdrawing your consent applies only to communications from Tria. Third parties may continue to send their own required notices, disclosures, or statements to you under their own terms and electronic communications policies. Tria is not responsible for the form, timing, or content of such third-party communications.
Updating Your Information
It is your responsibility to provide us with a true, accurate, and complete email address and your contact information, and to keep such information up to date. You understand and agree that if Tria sends you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, Tria will be deemed to have provided the Communication to you. You may update your information by logging into your Tria Account and visiting settings.
